Terms & Conditions

Last Updated: July 2026

Welcome to the website of 9 Division Inc. ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, wixstudio.com (the "Site"), as well as any forms, proposal requests, or preliminary consultations initiated through the Site.

By accessing or using our Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use of this Site.

1. Scope of Online Services

The information provided on this Site is for general informational purposes regarding our commercial construction, permitting, code compliance, and Certificate of Occupancy/Compliance services.

  • No Binding Contract: Submitting a form requesting a proposal or a "Free Quote" does not constitute a formal, binding contract for construction or consulting services. A binding relationship is only established once a separate, written Service Agreement or Construction Contract is signed by authorized representatives of both parties.

  • Accuracy of User Information: You agree to provide accurate, current, and complete details in all web forms, including your company name, physical business address, owner's name, and contact details.

2. Intellectual Property Rights

Unless otherwise stated, all content, graphics, logos, images, digital downloads, text, and project descriptions displayed on this Site are the property of 9 Division Inc. and are protected by United States and international copyright and trademark laws.

  • You are granted a limited, non-transferable license to access the Site for personal or internal business research.

  • You may not copy, reproduce, distribute, or exploit any materials from this Site for commercial purposes without explicit written consent from us.

3. Client Responsibilities & Scope Disclaimers

While 9 Division Inc. specializes in guiding business owners through permits, municipal inspections, and construction code compliance (such as the International Building Code), municipal approvals are subject to local government discretion.

  • Governmental Approvals: The ultimate issuance of a Certificate of Occupancy or Certificate of Compliance rests with the City of Houston, Harris County, or respective local jurisdictions. 9 Division Inc. does not guarantee a specific municipal timeline or processing window, as delays caused by government backlogs, building safety defects, or pre-existing code compliance violations are outside our direct control.

  • Site Feasibility: Any preliminary feedback given online or via phone based on your submitted occupant space square footage or property use description is provisional. A full code and property evaluation is required before physical milestones can be guaranteed.

4. Third-Party Links and Tools

Our Site may contain links to third-party web platforms, local government portals (e.g., municipal permitting centers), or tools (e.g., WhatsApp click-to-chat features). We do not monitor, control, or accept liability for the content, privacy settings, or functionality of external third-party websites. Interacting with external sites is entirely at your own risk.

5. Limitation of Liability

To the maximum extent permitted by applicable law, 9 Division Inc. and its directors, employees, or sub-contractors shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of—or inability to use—this Site. This includes, but is not limited to, reliance on informational text, potential server downtime, transmission of malicious code via third-party web hosts, or business delays related to preliminary project inquiries.

6. Indemnification

You agree to indemnify, defend, and hold harmless 9 Division Inc., its officers, and affiliates from and against any claims, liabilities, losses, expenses, damages, or costs (including legal fees) resulting from your misuse of this Site or your violation of these Terms.

7. Governing Law and Jurisdiction

These Terms and any disputes arising out of your interaction with this Site shall be governed by, interpreted, and enforced in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms must be filed exclusively in a state or federal court located in Harris County, Texas.

8. Amendments to These Terms

We reserve the right to revise or replace these Terms at any time without prior individual notice. The "Last Updated" timestamp at the top of this page will signify when changes take effect. Your continued use of the Site after revisions are published constitutes acceptance of the modified Terms.
